The ACT Lifetime Care and Support Scheme is a no-fault insurance scheme that ensures that Canberrans who are catastrophically injured in a motor vehicle accident or a workplace accident, can manage their ongoing care needs into the future.
Under this scheme, ACT motorists and private sector workers needing lifetime care as a result of a catastrophic injury, have the opportunity to access a scheme that provides long-term care and support.
What is covered by the Scheme?
The Lifetime Care and Support Scheme pays for:
- rehabilitation, and
- care for people who have been catastrophically injured in a motor vehicle accident or a workplace accident in the ACT.
The Lifetime Care and Support Scheme for motor vehicle injuries commenced in the ACT on 1 July 2014. It is funded by a levy on compulsory third party (CTP) insurance policies that commenced on or after 1 July 2014.
The scheme covers:
- motorbikes, and
- motor vehicles
so long as at least one vehicle involved in the motor accident had CTP cover, regardless of whose fault it is.
The Lifetime Care and Support Scheme for workplace accident injuries commenced in the ACT on 1 July 2016 and covers work place accident injuries occurring on or after 1 July 2016. The Scheme is fully funded through a levy collected from workers compensation insurers and self-insurers in the ACT.
Companion scheme to the National Disability Insurance Scheme
The Lifetime Care and Support Scheme is a companion scheme to the National Disability Insurance Scheme (NDIS) and its introduction is part of the implementation of the NDIS in the ACT. The Scheme aims to transform the way the ACT community supports people with a disability, their families and carers.
The scheme will help reduce the stress on those injured and their families that is often associated with litigating claims to meet ongoing treatment costs.
No fault schemes are now being recognised as the modern approach to managing the ongoing needs of personal injury. The scheme brings the ACT in line with other jurisdictions, with similar no-fault schemes already operating in NSW, Victoria, Tasmania and the Northern Territory.
Administration of the Scheme
The Lifetime Care and Support Commissioner of the ACT has entered into an arrangement with the Lifetime Care and Support Authority of NSW (Lifetime Care NSW) to manage the ongoing treatment and care support to the ACT Scheme participants with effect from 1 September 2015.
Lifetime Care NSW has expertise administering lifetime care and support schemes having operated a nearly identical scheme for a number of years
Lifetime Care NSW will assist the Lifetime Care and Support Commissioner of the ACT with eligibility and managing the ongoing treatment and care support for participants in accordance with the ACT Lifetime Care and Support Guidelines.
